ADJOURNMENT OF THE NKABINDE ENQUIRY FOR EASTER RECESS
PRETORIA – The Enquiry into the fitness of Advocate Andrew Chauke to hold office as Director of Public Prosecutions: South Gauteng has adjourned for a scheduled Easter recess.
The Enquiry, chaired by retired Justice Bess Nkabinde, adjourned on 31 March 2026 following the conclusion of the testimony of Advocate Chauke. The Enquiry will reconvene on Wednesday, 8 April 2026 at 09h00.
The testimony of Advocate Andrew Chauke was completed on 31 March 2026. His evidence, led in part by Advocate Tembeka Ngcukaitobi SC, included examination-in-chief, cross-examination, and re-examination. Counsel for Advocate Chauke has indicated that the defence case is provisionally closed.
Following the conclusion of his testimony, the Enquiry heard the evidence of Major General Jan Mabula. His evidence related to the investigation into the Cato Manor Organised Crime Unit, including the processes followed by the task team under his command and the interface between law enforcement and prosecutorial authorities.
Upon resumption, the Evidence Leaders will present further evidence. Witnesses expected to be called include Major General Johan Booysen and Advocate Shareen Riley. The Evidence Leaders retain the discretion to call additional witnesses as may be required.
The Chairperson, Justice Nkabinde, has indicated that the Panel remains committed to submitting its final report to the President by the end of May 2026.
The Nkabinde Enquiry Panel extends its wishes to all parties and members of the public for a safe and peaceful Easter.

ISSUED BY THE NKABINDE ENQUIRY
The Enquiry into the Fitness to Hold Office of Advocate Andrew Chauke (“the Enquiry”) was established by the President of the Republic of South Africa, His Excellency Mr Cyril Ramaphosa, on 29 September 2025, in terms of section 12(6)(a) of the National Prosecuting Authority Act 32 of 1998. The President appointed Justice Baaitse Elizabeth (“Bess”) Nkabinde, retired Justice of the Constitutional Court of South Africa, as Chairperson of the Enquiry, assisted by Panel members, Advocate Elizabeth Baloyi-Mere SC and Attorney Matshego Ramagaga (replacing the former Panel member Attorney Thenjiwe Vilakazi).
The Enquiry is mandated to investigate and determine whether Adv Andrew Chauke, the Director of Public Prosecutions for the South Gauteng Division, remains fit and proper to continue to hold office.
Specifically, the Enquiry will enquire into, report on and make recommendations on allegations set out in paragraph 3 of the Presidential Minute issued by the President dated 19 September 2025.
The Enquiry must be conducted with fairness, transparency, and must adhere to the rules of natural justice, ensuring that the process upholds the integrity and independence of the National Prosecuting Authority
Terms of Reference
In terms of the National Prosecuting Authority Act, read with section 179 (3) of the Constitution, the Directors of Public Prosecutions must be appropriately qualified, and must be fit and proper to be trusted with the responsibility of the office concerned and must exercise his/her functions without fear, favour or prejudice.
The Enquiry may review matters arising during Advocate Chauke’s tenure from 2011 to 2025, or any other period deemed relevant by the Chairperson insofar as it relates to the Terms of Reference. Should new matters emerge over the course of the Enquiry, such matters may be included in the scope of the Enquiry at the instance of the President.

Hearing
The Terms of Reference provide that the Chairperson shall determine the seat and rules for the Enquiry. The Chairperson has determined that the seat of the Enquiry will be the 29th Floor, 316 Thabo Sehume Street, Pretoria Central. The Chairperson has further directed that the Enquiry will begin the hearings from 17 November 2025.

Justice Baaitse Elizabeth Nkabinde
Chairperson
Justice Bess Nkabinde, who retired in December 2017 as a Justice of the Constitutional Court, practised law as an Advocate until she acted and was later appointed as Judge of the High Court in 1999. She was, later, privileged to act as a Judge in the Labour Court, Labour Appeal Court and Supreme Court of Appeal before her appointment in the Constitutional in January 2006. JUSTICE BAAITSE ELIZABETH (Bess) NKABINDE (BORN MOTSATSI)
Justice Bess Nkabinde, who retired in December 2017 as a Justice of the Constitutional Court, practised law as an Advocate until she acted and was later appointed as Judge of the High Court in 1999. She was, later, privileged to act as a Judge in the Labour Court, Labour Appeal Court and Supreme Court of Appeal before her appointment in the Constitutional in January 2006. In May 2016 to June 2017, Justice Nkabinde acted as Deputy Chief Justice of the Republic of South Africa and was privileged to act as Chief Justice, in November 2016.
While a Justice of the Constitutional Court, Justice Nkabinde was appointed to chair a Judicial Conduct Tribunal, the first of its kind, in terms of the Judicial Service Commission Act, concerning allegations of misconduct against certain Judges of the Gauteng High Court. After her retirement she was designated and served as Member and/or Chairperson of the Judicial Conduct Committee and Judicial Conduct Appeals Committee, respectively.
In 2018 until 2020, she was appointed Acting Judge of Appeal of the Supreme Court of Namibia, in Windhoek. She is currently, since 2022, a Judge of Appeal of the Court of Appeal of Botswana, in Gaborone.
Justice Nkabinde has held leadership roles across numerous Boards, Committees and other institutions, some of which she continues to hold, demonstrating her commitment to social justice and institutional integrity. Notable of these roles include her appointments as: Member of the Judicial Training Sub-Committee in the early 20s; Member of the Co-ordinating Committee of the Justice System on Racism and Sexism within the Judiciary in 2004; Chairperson of the Rules Board for Courts of Law (2004-2013); Chairperson – Disciplinary Inquiry established pursuant to the remedial action directed by the Public Protector in her Report into allegations of Improper Conduct regarding Mr D Mogajane’s application for the position of Director-General at National Treasury and his subsequent appointment to the same position by National Treasury (2019); Chairperson of the Independent Panel Established in terms of the Rules of the National Assembly on the Removal from Office (in terms of section 194 of the Constitution – of a Holder of Public Office in a State Institution Supporting Constitutional Democracy) of former Public Protector, Adv B Mkhwebane (November 2020 – February 2021); Chairperson of the Independent Ad Hoc Appeal Tribunal into the Ombud Report on Circumstances Surrounding the Care and Death of Mr S Lethole at Thembisa Tertiary Hospital (2022); and Member of Council – Rhodes University.
Additionally, Justice Nkabinde is a respected speaker and facilitator, having presented papers and led discussions on diverse legal and social topics both locally and internationally. Her passion for education is evident in her keynote contributions to institutions such as UNISA, North-West University, the International Women’s Peace Group, and the South African Judicial Education Institute. Through the collaborative programme initiated by the late former Chief Justice Pius Langa, she taught a course on the South African constitutional jurisprudence to post-graduate Law students at the Maryland Law School, Baltimore, USA.
Currently, the retired Justice serves as Director of School Aid South Africa, an NGO working in partnership with School Aid UK, the Department of Basic Education, Liberty, and Standard Bank to build and renovate libraries and provide books to underserved schools, promoting literacy among young learners. Additionally, she is a member of the Appointments Panel of the Press Council. She also serves on the Panel responsible for reviewing nominations to the South African Reserve Bank Board.

Advocate Baloyi-Mere is a Senior Counsel with experience in litigation, governance, and investigation. She holds an LLB. Advocate Lizzy Baloyi-Mere SC
Advocate Baloyi-Mere is a distinguished Senior Counsel (SC) with extensive experience in high-level litigation, institutional governance, and quasi-judicial investigation. She holds an LLB (University of South Africa).
Her professional career spans both the public service and the private bar:
Independent Investigator
Appointed by the Parliament of South Africa to conduct a sensitive, high-profile investigation into allegations of gender-based violence (GBV), sexual harassment, and misconduct involving Members of Parliament (EFF) and the Parliamentary Protection Services (PPS). This role required impartial fact-finding, legal rigour, and the submission of a public report with recommendations for institutional reform.
Judicial Experience
Served as an Acting Judge in the Gauteng Division of the High Court (Pretoria and Johannesburg) and the Free State High Court.
Legal Practice
Admitted as an Advocate in 2009, she has appeared in the Constitutional Court, Supreme Court of Appeal, and various High Courts across eight of South Africa’s provinces. Her specialist areas include Constitutional Law, Administrative Law, and Public Procurement Law.
Professional Governance and Oversight
Elected to the national Legal Practice Council (LPC), where she served on the Rules and Regulations Committee and the Education Committee. She is also a Commissioner in the Magistrates Commission and serves in the Ethics Committee, demonstrating a commitment to judicial accountability and ethics.
Leadership and Transformation
Former member of the Pretoria Bar where she served on the Bar Council, former Secretary and later Deputy Chairperson of AFT, Pretoria, former chairperson of a bar association, currently on the board of the Legal Practioners Development Fund (LPDF), actively championing transformation and providing mentorship to junior and black female practitioners.
Prior to her legal career, she was a teacher and co-founded the North West Teachers Union (1988-2008), providing her with a unique background in labour relations and social activism.
Ms. Matshego Ramagaga

Adv Vusi David Mtsweni (replacing former Evidence Leader Attorney Mabjana Pertunia Thulare) holds an LLB degree from the University of South Africa (UNISA). He was admitted as an advocate of the High Court of South Africa on 05 March 2009.

Mr Mmotse David Mohlamonyane holds a B.Iuris and LLB degree from the University of the North (UNIN). He was admitted as an advocate of the High Court of South Africa on 14 November 1996.
Professional Experience
Mr Mohlamonyane began his career in the Department of Justice as a Clerk of Court and Interpreter from 1982 to 1985. He later served as a Presiding Magistrate from 1985 until May 1996. Since July 2000, he has been practising as an advocate, with extensive experience across both civil and criminal law.
He was appointed by the President as Senior Advocate (Silk) with effect from 30 July 2019

Mr Mohlamonyane has played an active role in disciplinary processes within the justice sector. He prosecuted misconduct inquiries in 2001 and subsequently presided over numerous disciplinary inquiries between 2002 and 2021.

Adv. Phuti Setati
Advocate Phuti Setati serves as the Secretary of the Nkabinde Enquiry, responsible for administrative oversight, coordination of hearings, evidence management and ensuring strict compliance with procedural and legal requirements under the Enquiry’s Act. As a designated Advocate, he plays a pivotal role in facilitating the Enquiry’s operations, including organising logistics and maintaining the integrity of the enquiry process.
Advocate Setati is a highly experienced legal professional currently employed as a Senior State Law Adviser in the Office of the Chief State Law Adviser at the Department of Justice and Constitutional Development (DoJ&CD). He obtained both his B.Proc and LLB degrees in 1996 and 1998 respectively from the University of the North, now renamed University of the Limpopo and an LLM degree in Constitutional Interpretation from the University of Stellenbosch in 2000.
His career spans decades in public service, with a strong focus on high-stake judicial and investigative matters. He is best known for his exemplary leadership in managing complex Enquiry, including being appointed as-
- Secretary to the Marikana Judicial Commission of Inquiry (2012–2015), where he oversaw the administrative framework for this landmark investigation into the tragic police shooting at Lonmin’s Marikana mine, which resulted in 34 deaths. Under his stewardship, the Commission heard from over 200 witnesses, managed extensive evidence, and produced a comprehensive report that influenced national reforms in policing and labour relations;
- Secretary of the Presidential Remuneration Review Judicial Commission of Inquiry (PRRC 2015 – 2018) which inquired into the remuneration and conditions of service in the public service and public entities listed in schedule 3A and 3C of the Public Finance Management Act; and
- Secretary to the Judicial Commission of Inquiry into Allegations of Impropriety regarding the Public Investment Corporation (PIC Commission 2018–2022): Seconded to this role, Advocate Setati coordinated the inquiry into governance failures and ethical breaches at South Africa’s largest asset manager. His work supported the Enquiry’s final report which led to significant accountability measures and strengthened oversight in public finance.
With his deep expertise in administrative law, stakeholder coordination and impartial administration, Advocate Setati ensures the Nkabinde Enquiry operates efficiently and transparently, upholding the highest standards of justice.

In 2024, she was appointed as senior counsel. She has appeared in the Constitutional Court, the Supreme Court of Appeal, in almost all the High Courts in the country, the Competition Tribunal, the Labour Courts, the Land Claims Court and the Special Investigating Tribunal.
She has served as an Acting Judge in various divisions of the High Court. Her preferred areas of practice include administrative law, commercial and constitutional law, construction law and finance law.

Advocate Nkaiseng Khooe is a practising advocate. She holds a Master of Laws in International Economic Law (LLM), a Postgraduate Diploma in Labour Law from the University of the Free State, and a Bachelor’s degree from the National University of Lesotho. She began her career at the Free State Bar in 2013 before joining PABASA Bloemfontein Chambers in 2018.
She is a former part-time lecturer at the University of the Free State, is active in legal education and mentorship, and is committed to advancing transformation within the profession.
Advocate Khooe has established experience in high-level judicial inquiries, specialising in evidence leadership and witness examination.
